IS SPOUSAL MAINTENANCE (ALIMONY) GUARANTEED IN MY DIVORCE CASE?
Hi, my name is Lauren Fields. I am an attorney on the domestic litigation team at Roth Davies. Today I am going to answer some common questions asked to attorneys in divorce cases. Is my inheritance subject to division in a divorce? The answer is generally no. Anything that you were awarded from your parents through a gift or inheritance generally is awarded back to you. That being said, the appreciation on those inheritance may be subject to divorce. That means if you were awarded $20,000 in inheritance from the death of one of your parents and then that account accrued to $30,000 or $40,000 later on when you get divorced, that appreciation on those accounts may be subject to division.
